Terms & conditions for online orders 

These terms apply to purchases placed through the Chilli Collective storefront and are intended to explain how orders, payments, delivery, and support are handled.

Ordering and availability 

  • All orders are subject to product availability at the time payment is received.
  • We reserve the right to contact you if a bottle becomes unavailable, if stock needs to be substituted, or if we need to cancel and refund an item before fulfilment.
  • Because our sauces are naturally fermented and made from fresh, seasonal chillies, slight variations in color, heat level, and consistency may occur from batch to batch. This is a hallmark of a natural, artisanal product, not a defect.
  • The completion of a purchase on our website constitutes an offer to buy, which we accept only upon dispatching the product(s) to you.
  • We reserve the right to refuse or cancel any order for any reason, including limitations on available quantities, inaccuracies in product or pricing information, or suspected fraudulent activity.

Payment and shipping 

  • Orders only move into fulfilment once your payment provider confirms the transaction as successful.
  • You are responsible for providing an accurate delivery address, contact number, and email address at checkout.
  • All prices are listed in ZAR (Rand). We carefully package all our glass bottles to prevent breakage, but if your sauce arrives damaged, please send us photographic proof within 48 hours for a replacement. We currently ship nationwide across South Africa.
  • We accept payment via the methods listed on our website at the time of checkout. You represent and warrant that you have the legal right to use any payment method(s) you employ.

Fulfilment and delivery 

  • Delivery timelines depend on your courier zone and may vary during peak periods, public holidays, or severe weather conditions.
  • If a parcel is delayed, we will help you track it, but courier transit times remain outside our direct control once the order has been dispatched.
  • The risk of loss and damage to the products passes to you upon delivery to the address you specified.
  • Ownership of the products (title) will only pass to you once we have received full and cleared payment for them.

Returns and support 

  • Please inspect your order on arrival and contact us promptly if anything is missing, damaged, or incorrect.
  • Due to health and safety regulations regarding consumable goods, and in accordance with Section 16 of the Consumer Protection Act (CPA) regarding goods that by their nature cannot be returned, we cannot accept returns or exchanges on any opened bottles or perishable goods where the safety seal is broken.
  • If your order arrives damaged or incorrect, please contact us within 7 days of delivery with photos of the unopened product, and we will arrange a replacement or refund.
  • Nothing in these terms limits any rights available to you under applicable South African consumer protection laws, including the CPA.
  • Refunds will be processed to the original payment method used and may take 5-10 business days to appear in your account, depending on your financial institution.

Liability and safety 

  • Our products contain high levels of capsaicin. By purchasing, you acknowledge that these sauces are spicy and should be consumed responsibly.
  • The Chilli Collective is not liable for any discomfort, injury, or extreme sweating caused by underestimating the heat of our fermented habaneros. Keep out of reach of children and pets.
  • Our products are prepared in a kitchen that also handles other allergens. We cannot guarantee that our products are free from traces of allergens not listed in the ingredients.
  • To the fullest extent permitted by law, The Chilli Collective shall not be liable for any indirect, special, incidental, or consequential damages arising out of the use or inability to use our products.

General terms 

  • All content on this website, including logos, text, and images, is the property of The Chilli Collective and is protected by intellectual property laws.
  • Your use of our site and submission of personal information is governed by our Privacy Policy (available at /privacy-policy), which details your rights and our obligations under the Protection of Personal Information Act (POPIA). By using this site, you consent to the processing of your data as outlined in the Privacy Policy.
  • These Terms and Conditions shall be governed by and construed in accordance with the laws of the Republic of South Africa.
  • We reserve the right to update, change, or replace any part of these Terms and Conditions by posting updates to our website.
